This website is owned and operated by The Inspirational Bathroom Company ltd (06234141) whose registered office is at Grammar School House, Tarvin, Cheshire.

By using or accessing our website and/or placing any order(s) after viewing the website, you agree to be legally bound by these terms and conditions. If you do not wish to be bound then you may not use or access our website or place orders.

The contract made by you with us incorporates these terms and conditions.

You will not be able to proceed with your purchase until you have read and agreed to these terms and conditions.

1.Product Specifications

1.1
We have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to sales.

1.2
Products supplied may differ as a consequence from those advertised. Unless agreed with you, the products supplied will be of equivalent value functionality and appearance.

1.3
Some items are made from quality natural wood and accordingly appearances may vary.

1.4
We endeavour to display as accurately as possible the colours of our products on the website. However we cannot guarantee the complete accuracy of the pictures or photographs that are shown.

1.5
All steam showers, steam rooms, saunas, shower enclosures, whirlpool baths and equivalent products are delivered as self-assembly units. Please contact us for more information about the number of packages, size and with any delivery questions you may have before ordering.

2. Measurements

We will not accept any liability for any extra costs incurred by you as a result of your incorrect measurements.

2.2
All dimensions specified by us are approximate only.

3. Prices

3.1
All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.

3.2
Goods are delivered on weekdays directly to your home address and delivery prices shown are based upon delivery within the UK or Republic of Ireland, You will be notified of the delivery charge before you complete your purchase.please read our section "Postage Terms" relating to AM or Saturday deliveries.

3.3
The prices displayed on the website in relation to any on-line promotion are valid strictly until midnight on the day on which the promotion expires unless stated otherwise by us.

4. Payment

4.1
You may pay by credit, charge or debit card at the time of order, or by cheque or bank transfer by arrangement The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website, telephone, email or other means will be correct; that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.

Payment will be taken in full at the time of the order unless the item is not in stock and you wish to place only a deposit.

We are entitled to refuse any order placed by you.

If you wish to pay by cheque or bank transfer, please contact us first by phone or email. Your order will be dispatched when the cheque has cleared.

5. Delivery

5.1
We are able to deliver orders to you only if you have a permanent residential address in the UK.

5.2
Orders will be dispatched by courier.

5.3
For all orders - any changes made to the content of your order will have an impact on your delivery date. We may therefore be unable to deliver your goods on your confirmed delivery date should changes occur and if so a new delivery date will be given.

5.4
You are responsible for providing a safe means of access from the public highway to the place of delivery. If our delivery provider considers that access is unsafe then we will not deliver the goods until safe access is provided, for more detailed information about the size of the delivery please contact us on 01244 400994

5.5
If you are unable for whatever reason to take delivery of your goods on the confirmed delivery date or we are unable to deliver the goods due to there being no safe means of access to the place of delivery we will be entitled to cancel your order and refund your payments less an administration fee of 20% of the order value (up to a maximum of £50 including VAT).

5.6
If we accidentally damage goods in the course of delivery our liability for that damage is limited to the repair replacement or refund of the goods or the value thereof.

5.7
Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of The Inspirational Bathroom Company or its subsidaries, or any reasonable rescheduling of delivery.

6. Installation

The products we sell require qualified trade people to fit (Plumbers/Electricians). Failure to get the product fitted by a qualified trade person will invalidate your warranty and we shall not be held liable for any problems or damages arising from fitting or failure.

7. Returns, Refunds and Your Right to Cancel

7.1
You have the statutory right to return any products you have purchased within seven working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing within those seven working days. You will then be entitled to a refund from us, which will be paid within thirty days of your notice of cancellation. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided. You will be refunded the full cost of the product minus any delivery changes. If you return a product you are also liable for this charge.

7.2
After this 7 day period has expired you may in certain circumstances still cancel your order and return the products you have purchased but we will retain and administration fee of 20% of the order value (up to a maximum of £75 including VAT).

7.3
Subject to your statutory rights, products made or altered specifically for you, may not be returned nor will we provide any refund, unless they are defective or have been accidentally damaged by us in the course of delivery.

7.4
If we deliver incorrect or damaged goods, or in the event that you discover any defect in the goods for which you require compensation or other remedy, you must report the defect within 14 days of the date you receive them, or as soon as possible thereafter by contacting our Customer Services Helpline on 01244 400994. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided.

7.5
We will not be liable for any damage or loss resulting from repairs attempted by you or third parties.

8. Guarantees and Claims under Guarantee

8.1
The provisions of this clause apply in addition to your statutory rights in relation to faulty or misdescribed products. These rights are not affected by the guarantee.

8.2
The guarantor is: The Inspirational Bathroom Company

8.3
We guarantee all products against faulty workmanship and/or faulty materials for a period of 12 months from the actual date of delivery.

8.4
These guarantees do not cover fair wear and tear; neglect; abuse or misuse of your goods; loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party. The guarantee excludes all bulbs and fluorescent tubes.

8.5

8.6
We will arrange to repair or replace the defective or incorrect item free of charge. Should a part no longer be available, it will be replaced with a part that most closely matches it.

8.7
We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves.

9. Site Content and Disclaimers

9.1
Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors, as soon as possible but we cannot be responsible for any losses incurred.

9.2
To the maximum extent permissible by law, we exclude all warranties, express or implied as to the accuracy of the information contained in any of the materials on this website. We cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon the information contained on this website.

9.3
Any material downloaded or otherwise obtained through the use of this website is done at your own discretion and risk and you will be solely responsible for any damage to your own computer system or loss of data that may result from the download of any such material.

10. Jurisdiction

We control and operate the web site from our offices within England. Accordingly the laws of England and Wales govern claims relating to the use of this web site and the materials contained therein. If you choose to access our web site from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between us and you the laws of England and Wales apply at all times.
